Assam Govt Omits Major Clause in Motor Vehicles Act

Guwahati, September 25, 2019:

Assam state government, while implementing the newly implemented Motor Vehicle (MV) Act, has omitted a major clause which was meant to be followed in all the states of the country.

It has removed Clause 89, Sections 210 (A) and 210 (B) of the MV Act. As per the Gazette of India, the Motor Vehicle (Amendment) Act 2019 stated that any government official who violates the rules set by the act shall need to pay a penalty which is double the amount that a non-government employee has to pay.

But the Assam State government has removed both and introduced the new MV Act.

Clause 89, Section 210 (A) states, “Subject to conditions made by the Central Government, a State Government, shall, by notification in the Official Gazette, specify a multiplier, not less than one and not greater than ten, to be applied to each fine under this Act and such modified fine, shall be in force in such State and different multipliers may be applied to different classes of motor vehicles as may be classified by the State Government for the purpose of this section.”

While Section 210 (B) states, “Any authority that is empowered to enforce the provisions of this Act shall, if such authority commits an offence under this Act, shall be liable for twice the penalty corresponding to that offence under this Act.”

Speaking to Inside Northeast, Officer of the Kamrup District Transport Office (DTO), Gautam Das said, “It is clearly mentioned in the new amendment act that anyone who commits any offense shall have to pay the penalty or be punished. Anyone who witnesses an individual not following the rules can inform the authorities. Video footage can also be submitted to the Court or transport authority for legal action. S/he will be charged after summoned by the court. The legal officers will look into the case.”

However, the officer refrained from commenting on the omission of the Clause.
