The Bharatiya Gorkha Parisangha, Assam State Committee, led by its President Nityananda Upadhyay, called on Asutosh Agnihotri, Commissioner & Secretary, Home, Political and Passports, and sought an early resolution of the issue.
The delegation requested the Government of Assam to a file fresh case at the Foreigners Division of the Gauhati High Court, as directed by the court while hearing Case No. I. A. (Civil) 4322/2018, and give relief to more than 20,000 D Voters who have been excluded from the final NRC.
The meeting co-ordinated by Nanda Kirati Dewan, National Secretary (Youth Affairs), BGP was attended by Assam BGP General Secy S Prakash Dahal, VP Amar Adhikari and Dr. Dilip Chhetri.
Informing about the meeting, S Prakash Dahal said, 'We had an elaborate discussion regarding the order of IA filed by Home Deptt. Govt of Assam and order pronounced on 20th Dec 2018.
Asutosh Agnihotri has taken responsibility to see why it is necessary to file a writ petition in the High Court to validate the notification by MHA and if all it is necessary why was it not filed on time. And if it is necessary to file a fresh writ petition, the government will seek legal opinion from the concerned department and follow the process and settle the issue on time.'
Nanda Kirati Dewan also the President of Bharatiya Gorkha Yuva Parisangha (BhaGoYuP) said, "It has been seven months since the order was passed and it is public domain. The Gorkhas of Assam expected the 'Sabka Saath - Sabaka Vikash' government to do the needful without reminders and take necessary measures to writeoff D cases of Gorkhas of Assam, but sadly it didn't happen and today an estimated more than one lakh have been excluded due to cases of D Voters.."
'This is not just disrespect to the community but also denial of principles of democracy,' the youth leader added.
With this representation today, the Bharatiya Gorkha Parisangha puts it on record requesting Government of Assam to the needful as advised within the stipulated time of 120 days and relieve Gorkhas being asked to appear in the Foreigners Tribunals for being excluded from the NRC.
The MHA Notification on Clarification of Gorkha D Voters was released on PIB website on 10th Oct 2018 stating Gorkhas cannot be tried in FT Courts.

It may be mentioned here that over 1 lakh Gorkhas have been left out of the NRC. The Parisangha is seeking further safeguards for the Gorkha community under the provisions of Clause 6 of the Assam Accord.
