A petition has been filed challenging the same claiming it violates "constitutional rights."
The Gauhati High Court has instructed the Assam Government to submit an affidavit regarding the same within two weeks.
In February last year, BJP led Assam Government has decided to close down state-run Madrasas and Sanskrit 'tols' and converted them to schools teaching regular courses.
Minister Himanta Biswa Sarma said earlier that it is not the government's job to teach religion at their expense.
According to Sarma, the state of Assam has 1,200 madrassas and 200 Sanskrit tols as of now without any independent boards to run them.
