Children born after December 3, 2004 will be ineligible to be included in the final National Register of Citizens (NRC) Assam.
The bench comprising Chief Justice of India, Ranjan Gogoi and RF Nariman, on August 13, ruled out the reopening and reverification of the NRC. As per suggestions (b) and (c) in Paragraph 7 of the report submitted to the Court by NRC State Co-ordinator Prateek Hajela, children born after December 3, 2004 are not eligible to be included in the NRC list, if any of the parent is a DV (Doubtful Voter), DF (Declared Foreigner) or PFT (persons with cases pending at Foreigners Tribunals).
Suggestions (b) and (c) are as follows –
(b) For those persons born before 3 December 2004, if the parent through whom legacy is drawn is not DV or DF or PFT and is found eligible for inclusion in NRC, but the other parent from whom legacy is not drawn is a DV or DF or PFT, then, such descendants may be included in NRC.
(c) For those persons who are born on or after 3 December 2004, they will not be included in NRC if any of the parent is DV or DF or PFT even if the parent from whom legacy is drawn is clear from all angles.”
The Supreme Court said that suggestions (b) and (c) were in consonance with Sections 3(1)(b) and 3(1)(c) of the Citizenship Act 1955 (Act), as per which descendance is the criteria for determining the citizenship of those born after July 1, 1987.
Objections were raised against these suggestions that exclude children born after December 3, 2004. The final publication of NRC is due on August 31. People of Assam have been actively participating in proving their citizenship over the past few years. The (b) and (c) suggestions have furthered the confusion among the people of the state.
