The Ministry of Home Affairs (MHA) revealed at the Rajya Sabha session that army veteran Mohammad Sanaullah could not produce any proof of his citizenship and neither could he produce any legacy data before 1971.
The revelation was made as a part of reply by the MHA to the question of Congress MP Ananda Sarma.
As per the Citizenship Act of 1946, Paragraph 9, Sanaullah could not produce any legacy data in front of the Foreigner’s Tribunal. It has been alleged that he could not even produce his 'birth certificate' as per MHA reports.

The Centre informed that he was served with the foreigner’s notice based on the information given by the local residents of Kolohikas village in Chaygaon, Assam.
It is to be mentioned that Mohammed Sanaullah, a retired captain of the Indian Army from Kolohikas village in Chaigaon, Assam had been declared as a foreigner by the Boko Foreigners’ Tribunal (FT).
According to reports, there was a pending case against Sanaullah at the Foreigner’s Tribunal in Boko. As he tried to trace the case at the office of the SP (border), Kamrup Rural, the Foreigners’ Tribunal in Ulubari and in Boko, he finally found out from the Boko FT that the case registered against somebody named Md Samsul Hoque of Agchiya Village in Boko.
Sanaullah joined the army before 1987 and served the army for 30 years. He retired on May 31, 2017. He then joined Assam Police in 2018.
He took part in three counter-insurgency operations in Doda district and near the LOC in Tangdhar sector of Kupwara district in Jammu and Kashmir from 2015 to 2017. He also took part in counter-insurgency operations at Leimakhong in Imphal West district of Manipur from 2007-2010.
On September 2, 2014, Sanaullah was presented with the 'Certificate of Appreciation' from the President of India. He completed his schooling from Champupara High School. His nephew informed that the names of Sanaullah’s wife, son and two daughters were excluded in the NRC draft. Whereas, both of his brother’s names appeared in the NRC draft.
