FIR filed in Dhubri over alleged fake birth certificate used in Gauhati High Court case
A resident of Dhubri district has filed a First Information Report (FIR) alleging forgery, cheating and criminal conspiracy against a couple accused of fabricating a birth certificate to evade disqualification under Assam’s panchayat laws and allegedly misleading the Gauhati High Court.
The complaint was lodged at Dhubri Police Station by Mohibul Hoque, a resident of Kachuar Khas Pt-I village. The FIR names Janobi Mandal (27) and her husband, Basir Uddin, as the accused.
According to the FIR, the alleged forgery was carried out to protect Janobi Mandal from possible disqualification linked to provisions under Assam Panchayat laws concerning child marriage and eligibility criteria submitted during the nomination process.
The dispute centres around two separate birth records of the couple’s son, Sakib Hasan. One birth certificate, issued by Dhubri Civil Hospital on July 13, 2015, reportedly records the child’s date of birth as June 3, 2015. However, another certificate allegedly issued by Gauripur Community Health Centre on February 5, 2026, mentions the birth date as January 15, 2017.
The complainant stated that suspicion arose after the second certificate was submitted as evidence in a writ petition before the Gauhati High Court. To verify its authenticity, Hoque filed a Right to Information (RTI) application with the Registrar of Birth and Death at Gauripur CHC.
According to the FIR, the official RTI reply dated March 24, 2026, confirmed that the certificate bearing Registration No. B2026990347006333 does not exist in official records and is fake.
The FIR further alleges that the accused entered into a criminal conspiracy to fabricate public documents in order to obstruct lawful proceedings and mislead the Constitutional Court by presenting forged evidence.
“The accused deliberately fabricated a false public document to mislead the Hon’ble High Court and defeat statutory proceedings,” the complaint stated.
Hoque has urged police to register the matter under relevant provisions of the Bharatiya Nyaya Sanhita, 2023, dealing with forgery, cheating and criminal conspiracy.
Police are expected to launch a detailed investigation into the matter, including whether any government officials or outside individuals were involved in preparing the alleged forged document.
