Section 163 BNSS imposed in Assam’s Kokrajhar ahead of April 9 polls
The District Magistrate of Kokrajhar, Pankaj Chakravarty, has promulgated a prohibitory order under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) in view of the upcoming General Elections to the Assam Legislative Assembly scheduled for April 9.
The order has been issued to maintain law and order and ensure the peaceful conduct of elections across the district.
According to the notification, unauthorised assemblies or gatherings of five or more persons have been prohibited during the election period. The use of premises or grounds of educational institutions, government offices and guest houses for election campaign purposes without prior authorisation has also been restricted.
The carrying of firearms, explosives, incendiary materials and other weapons capable of causing harm to persons or property has been strictly prohibited. However, this restriction will not apply to police personnel, paramilitary forces and other authorised law enforcement agencies while on official duty.
The order also bans the bursting of firecrackers and display of fireworks in both public and private places if they are likely to disturb peace and tranquility. Organising or holding public meetings, rallies or processions without prior permission from the District Magistrate has also been prohibited.
Further, the notification bars inflammatory or communal speeches, anti-state or anti-national slogans, and the display of banners, posters or wall writings that could disrupt public harmony. Unauthorised public feasts or parties during the election period, as well as the distribution of liquor, intoxicants, cash or any other inducements to voters, have also been strictly prohibited.
The prohibitory order has come into force with immediate effect and will remain in place throughout Kokrajhar district during the election period. Authorities have warned that any violation of the order will invite prosecution under the relevant provisions of the Bharatiya Nyaya Sanhita, 2023.
