Nagaland Govt reduces sentence of prisoners

The Nagaland government has decided to remit the sentences for certain categories of prisoners who have been convicted by the courts (other than Court Martial).

Dimapur: The Nagaland government has decided to remit the sentences for certain categories of prisoners who have been convicted by the courts (other than Court Martial) having criminal jurisdiction in the state and sentenced to rigorous imprisonment with effect from August 15.

The remission was done to commemorate the 75th anniversary of Independence Day.

An official notification on Tuesday has said in exercise of the power conferred by Sub-section 1 of Section 432 of the Code Criminal Procedure, 1973 (Act No. 2 of 1974), the State Government has granted remission of sentences to the different categories of prisoners, lodged in the jails of Nagaland and outside, other than those in respect of whom the sentence is inflicted for an offence against the order referred to in Sub-section 6 of Section 432 of the Code passed under any law relating to which the executive powers of the Union extends.

The scale of remission of sentences for different categories is- prisoners sentenced to 10 years and above  (30 days), prisoners sentenced to 5 years to 10 years (20 days), prisoners sentenced to 1 year to 5 years    (10 days) and prisoners sentenced up to 1 year (5 days).

However, the remission will not be admissible to the prisoners convicted under Foreigners Act, Passport Act, Unlawful Activities (Prevention) Act, Section 3 to 10 of Official Secrets Act, 1923, Section 2 to 3 of Criminal Amendment Act, 1961, Section 121 to 130 of IPC, Section 107/109 of CrPC, Prevention of Corruption Act, for rape, attempt to rape or assault on women, violating jail rules and discipline such as threatening/ intimidation/quarrelling/beating of fellow prisoners/staff and smuggling of contraband and prohibited articles and foreign nationals convicted under any Acts.
