Assam: Rent Authority to regulate premises' rent soon; Bill tabled in Assembly

GUWAHATI: Pijush Hazarika, Minister of Parliamentary Affairs, introduced Assam Tenancy Bill, 2021 in the Legislative Assembly yesterday on behalf of Ashok Singhal, Minister of Urban Development Department.
The bill seeks to repeal Assam Urban Areas Rent Control Act, 1972. As per the bill, there will be no artificial cap in fixing the rent of a premise and the rent of a building will be market driven which will be determined by the tenant and the landlord through a mutual agreement.
The bill intends to simplify and fast the procedure of redressal of disputes between landlords and tenants through establishment of a rent authority, a rent court and a rent appellate at the district level to protect the interests of landlords and tenants.

The bill has also simplified the process of eviction of a tenant in case of non-payment of rent as well as non fulfilment of the conditions of agreement has also been simplified to eliminate fear of the landlord losing rights to his property.
The provisions of the Bill will, however, not apply to certain premises, including those owned or promoted by the government, religious or charitable organisations, and Waqf authorities.
The Bill also clearly specifies duties and obligations of each party on maintenance and upkeep of the premise.
There will be no financial burden on the state exchequer on account of the Bill.
